Moral agency and "holding people responsible" for their actions is all well and good as a philosophy. (Well, I'm not sure it is, but certainly, it's respectable as a world outlook.) Government isn't about moral philosophy, it's about protecting citizen's lives and liberties. If we can save lives without placing and undue burden, do it. Whether this theoretically lets people off the hook has nothing to do with it.
